September 2018: A class-action lawsuit was filed against Essentia Water, LLC for allegedly falsely marketing its line of water with 9.5 pH or higher using phrases such as “overachieving H2O” and “Ionized Hydration” and a plus sign to convey the message that the water provides superior hydration than other waters when, according to the complaint, such claims are false and the company does not have adequate scientific evidence to support its claims. (Kennedy et al v. Essentia Water, LLC, Case No. 18-cv-5257, E. D. NY.)
