May 2016: A class-action lawsuit was filed against DSW (a store that sells shoes, handbags, and accessories) for allegedly deceptively advertising price discounts on merchandise sold only at DSW stores by comparing a discounted price to a false original price. In addition, the complaint claims the original price was never the prevailing market price within the three months immediately before the advertisement, as required by California law. (Evans et al v. DSW, Inc., Case No. 16-cv-3791, C. D. CA.)
