In April 2019, a class-action lawsuit was filed against Kate Spade & Company for allegedly misleadingly advertising “grossly overstated” discounts on merchandise sold at its outlet stores. Specifically, the complaint claims that the outlets deceptively represent that consumers are getting a significant percentage off of an advertised regular price when, according to plaintiffs, the merchandise was never sold at the represented regular price. (Calderon et al v. Kate Spade & Company, LLC, Case No. 19-cv-674, S. D. CA.)
