In February 2019, a class-action lawsuit was filed against Kate Spade & Company for allegedly deceptively advertising discounts on merchandise sold at its outlet stores by representing that the regular price of merchandise is discounted by a specific percentage when, according to the complaint, the represented regular price is a “total fiction.” (Schertzer et al v.
