In May 2019, a class-action lawsuit was filed against Chico’s for allegedly misleading consumers into thinking they are getting a significant discount on merchandise sold at outlet stores when they’re not. The complaint claims that the store misleadingly represents that consumers are getting a substantial percentage discount off of a false reference price when, according to the complaint, the merchandise is created exclusively for the outlet stores and is never actually sold at the reference price. (Fisher et al v. Chico’s FAS, Inc., Case No. 19-cv-856, S. D. CA.)
