Why this eyewear company’s advertised “starting” prices may not be 20/20.
October 2014: A federal judge granted the defendants’ motion for summary judgment finding that the plaintiffs did not present competent evidence from which a reasonable juror could conclude that the “defendants used their alleged domination of Kangadis Food Inc.” as means of falsely advertising the oil. June 2014: After the Ebin case was stayed because the company filed for bankruptcy, the Court gave plaintiffs permission to re-file a related action. The next day, plaintiffs filed a complaint alleging that Kangadis Family Management falsely labels its olive oil as being “100% Pure Olive Oil” when, according to the complaint, it is industrially produced, chemically derived fat known as pomace. (Ebin et a. v. Kangadis Family Management LLC et al, Case No. 14-cv-1324, S. D. NY.).
April 2013: A class-action lawsuit was filed against The Gourmet Factory, the company that markets Capatriti Oil, for misleading and deceptive marketing. Specifically, the complaint alleges that The Gourmet Factory markets the oil as “100% Pure Olive Oil” when, according to the complaint, it actually consists of an industrially produced, chemically derived fat known as pomace, which does not appear in pure olive oil.
