February 2020: A federal judge dismissed the complaint concluding, among other things, that reasonable consumers would not be misled by the marketing claims.
June 2019: Plaintiffs filed an amended complaint bringing similar allegations.
November 2018: A class-action lawsuit was filed against BEF Foods for allegedly misleadingly giving consumers the impression that Bob Evans Mashed Potatoes contain butter when, according to plaintiffs, the products contain a “butter blend” composed of both butter and vegetable oils. Plaintiffs also claim that the company falsely markets the products as fresh when, according to the complaint, they contain artificial chemical preservatives and are not fresh. (Sarr et al v. BEF Foods, Inc., Case No. 18-cv-6409, E. D. NY.)
