January 2015: This action was voluntarily dismissed When a complaint is dismissed without prejudice, an amended version of the complaint can be refiled.. The reasons have not been disclosed.
May 2014: A class-action lawsuit was filed against Bai 5 for allegedly deceptively marketing the Bai 5 Antioxidant Infusions, including the Brasilia Blueberry, Malawi Mango, and Sumutra Dragonfruit flavors. Specifically, plaintiffs claim that the marketing materials – such as the product labels and website – represent that the beverages contain antioxidants without listing the specific nutrient that is an antioxidant, as required by federal regulations. (Hechler et al v. Bai Brands LLC d/b/a Bai 5, Case No. 14-cv-02848, E. D. NY.).
