Companies should not be able to trap consumers into subscriptions that they do not want.
In February 2019, a class-action lawsuit was filed against Anthem and Blue Cross and Blue Shield of Georgia for allegedly deceptively marketing Anthem’s Pathway Health Plan policy during the open enrollment period from November to December 2018. Plaintiffs claim that the insurance companies deceptively represented that WellStar Health System, which is Georgia’s largest healthcare provider, would be covered as an in-network provider when, according to the complaint, Anthem notified WellStar in August 2018 that it would not be providing policyholders with coverage for expenses from WellStar’s services in 2019.
