NuBra

Support is a key feature of any bra -- support for advertising claims, that is.

The marketers of the NuBra claimed that the adhesive bra was “proudly handmade in the U.S.A. since 2002.” But unlike the bra, the claim didn’t stick.

In response to an inquiry by the FTC, the company changed the language in a logo on its website from “proudly handmade in the U.S.A. since 2002” to “proudly made since 2002.” It was one of several steps NuBra took to correct its made in the USA marketing to “avoid deceiving consumers,” according to a recent FTC closing letter. The Pomona, California-based company also updated claims on packaging and labels, social media pages and trade show materials.

The FTC found that “although certain [NuBra] adhesive bras are made in the United States, [NuBra] also sells products that contain significant imported content.” The FTC’s Made in USA standard calls for products marketed with an unqualified U.S.-origin claim to be “all or virtually all” made here. Anything less and the product cannot bear a claim like “handmade in the U.S.A.”

Based on the company’s actions, the FTC let NuBra off with a warning.
